# Akitle Glossary

A glossary of Turkish rental law and contract management: TBK, HMK, KVKK references; for each term: definition, legal basis, example, and related contracts.

- [Rental contract](https://akitle.com/en/glossary/rental-contract.md): A bilateral contract governed by Turkish Code of Obligations arts. 299 et seq., in which one party transfers the use of a thing to another for a fee.
- [Eviction undertaking (tahliye taahhüdü)](https://akitle.com/en/glossary/eviction-undertaking.md): A residential or workplace renter's written commitment to vacate the property on a specific date. Governed by TBK art. 352/I; must be given after the lease begins.
- [Electronic signature](https://akitle.com/en/glossary/electronic-signature.md): Electronic data attached to or logically associated with another electronic record for authentication purposes (Turkish E-Signature Law No. 5070 art. 3/b). Secure e-signature is a distinct, narrower category.
- [Force majeure](https://akitle.com/en/glossary/force-majeure.md): An external event that makes contract performance impossible; blameless, unavoidable, unforeseeable. Under TBK art. 136 it releases the obligor from performance.
- [Security deposit](https://akitle.com/en/glossary/security-deposit.md): An amount or security instrument the lessor receives at lease start to secure claims (unpaid rent, damage, tax). For residential and roofed-workplace leases, capped at 3 months' rent under TBK art. 342.
- [Guarantor](https://akitle.com/en/glossary/guarantor.md): A third party held liable for the same debt if the principal debtor fails to pay (TBK art. 581). In rental contracts, a guarantor secures against non-payment and damage risk.
- [Bare vs operated rental](https://akitle.com/en/glossary/bare-vs-operated-rental.md): In bare rental, the machine is delivered alone and the renter brings their own operator. In operated rental, the operator stays with the lessor; the social-security and liability structure changes.
- [Audit trail](https://akitle.com/en/glossary/audit-trail.md): An append-only, timestamped record of every event in a contract's lifecycle: creation, sharing, opening, field filling, signing. Akitle stores this as a document under HMK art. 199.
- [Rental deposit](https://akitle.com/en/glossary/rental-deposit.md): The amount a tenant gives the landlord to secure obligations arising from the lease (rent, damage, dues), capped at three months' rent under TBK art. 342 for residential and roofed-workplace leases, and required to sit in a blocked time-deposit bank account rather than being handed over as cash.
- [Advance rent payment (peşinat)](https://akitle.com/en/glossary/advance-payment.md): Paying one or more future months' rent upfront, at the start of the lease. Not a security — it directly discharges rent debt and is not returned; this is what separates it from a deposit or teminat.
