Legal framework
Under Turkish Code of Obligations (TBK) arts. 299 et seq., written form is not a validity requirement for rental contracts; the parties' mutual consent forms the contract under TBK art. 1. The medical device manufacturer/distributor carries product liability under Law No. 4703 on Technical Regulations for Products — this liability cannot be transferred to the patient by contract. Is a prescription copy required in a medical equipment rental contract?
For prescribed devices (oxygen concentrators, CPAP devices, continuous-use monitors), a prescription copy is mandatory — both as legal documentation and for reimbursement records with Turkey's social security agency (SGK). The Akitle template includes a prescription upload field as standard.
Whose responsibility is wheelchair hygiene during rental?
Pre-delivery disinfection is the lessor's responsibility (per Turkish Ministry of Health disinfection regulations). Daily cleaning during use is the renter's. Pre-return disinfection is again the lessor's and is typically included in the rental fee.
In hospital-use corporate rentals, who is the invoice issued to?
The corporate party to the contract (the hospital or medical center) is listed as the party; the invoice is issued to that legal entity. The patient is listed only as the user; they are not a party to the contract. This structure is important for SGK reimbursement.
How quickly does a replacement device arrive if the equipment fails?

Should the calibration certificate be attached to the contract?

Is the Akitle signature a qualified e-signature (Law 5070)?
No. Akitle produces a binding document and an audit trail between the parties; the document constitutes evidence under HMK art. 199. Where wet-ink equivalence is required — such as handing over a prescribed device — a notary or qualified e-signature is recommended.
