How is a contract formed?
Under Turkish Code of Obligations (TBK) art. 12, a written form is not a validity requirement for a rental contract. A contract signed via Akitle is formed under TBK art. 1 as long as the parties' mutual intent exists, and is binding between them.
Evidentiary value in court
An Akitle document is a 'document' under Turkish Civil Procedure Code (HMK) art. 199 and a 'commencement of written evidence' under art. 202; it opens the path to proof with witnesses. It is NOT a 'secure electronic signature' under Turkish Law No. 5070 — it does not produce the 'conclusive deed' effect (HMK art. 205/2) that an ESHS-certified signature does.
Eviction undertaking warning
Eviction undertakings (tahliye taahhüdü) under TBK art. 352/I may only be given AFTER delivery of the leased property. Otherwise they are deemed invalid under the 1944 unification of jurisprudence ruling. For this special case we recommend consulting a lawyer.
